We collect information you provide directly to us, information we collect automatically when you use the Platform, and information from third-party sources.

1.2 Information Collected Automatically

When you use the Platform, we automatically collect certain information including:

  • Usage Data: Pages viewed, features used, search queries entered, bids clicked, alerts configured, and time spent on the Platform
  • Search History: Keywords, NAICS codes, and filters you use when searching for bid opportunities
  • Device Information: IP address, browser type and version, operating system, device identifiers, and screen resolution
  • Log Data: Server logs recording your visits, including timestamps, referring URLs, and error logs
  • Session Data: Authentication tokens used to maintain your logged-in session

1.3 Information from Third Parties

We may receive information about you from third-party services such as payment processors (billing verification) and analytics providers. We do not purchase or obtain personal data from data brokers.

2. How We Use Your Information

We use the information we collect for the following purposes:

  • Sending transactional emails such as account confirmation, password reset, and billing receipts
  • Sending bid alert notifications matching your saved alert criteria
  • Sending product updates, new feature announcements, and service notifications (you may opt out of non-essential communications)
  • Responding to your support inquiries and customer service requests

2.3 Analytics and Research

  • Analyzing aggregate, anonymized usage patterns to understand how users interact with the Platform
  • Measuring the effectiveness of our features and identifying areas for improvement
  • Conducting internal research to develop new features and services

3. Cookies and Tracking Technologies

BidsNexus uses cookies and similar tracking technologies to operate the Platform, remember your preferences, and analyze usage.

3.1 Types of Cookies We Use

  • Essential Cookies: Required for the Platform to function. These include authentication session cookies that keep you logged in. These cannot be disabled.
  • Preference Cookies: Remember your settings such as search filters and display preferences.
  • Analytics Cookies: Collect aggregate data about how users interact with the Platform to help us improve the service. These are set by Google Analytics.
  • Performance Cookies: Help us understand page load times and identify technical issues.

3.2 Managing Cookies

Most web browsers allow you to control cookies through their settings. You can configure your browser to refuse cookies, or to alert you when cookies are being sent. Note that disabling essential cookies will prevent you from using certain features of the Platform, including staying logged in. You can opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on.

4. Third-Party Services

We use the following categories of third-party services that may receive or process your data:

4.1 Google Services

We use Google Analytics to collect and analyze aggregate usage data. Google may collect your IP address and usage patterns through analytics cookies. We have configured Google Analytics to anonymize IP addresses. Google's privacy policy is available at policies.google.com/privacy. We also use Google Fonts for typography — font files are loaded from Google's servers, which may log your IP address.

4.2 Payment Processor

Subscription payments are processed by a PCI-DSS-compliant third-party payment processor. When you enter payment information, it is transmitted directly to the payment processor using secure encryption. BidsNexus does not store your full credit card number on our servers. We receive a tokenized reference and basic billing information (last four digits, expiry, billing address) to manage your subscription.

4.3 Email Delivery

We use a third-party email service provider to deliver transactional emails and bid alert notifications. This provider processes your email address and the content of emails sent on our behalf, subject to their privacy and data processing terms.

4.4 Cloud Infrastructure

The Platform is hosted on cloud infrastructure providers that may store data in the United States. These providers are subject to contractual data processing agreements with BidsNexus.

5. Data Sharing and Disclosure

BidsNexus does not sell, rent, or trade your personal information to third parties for their own marketing or commercial purposes. We may share your information only in the following limited circumstances:

  • Service Providers: With vetted vendors who process data on our behalf (payment processors, email providers, cloud hosts) under contractual data protection obligations
  • Legal Requirements: If required by law, court order, or governmental authority, or to protect the rights, property, or safety of BidsNexus, our users, or the public
  • Business Transfers: In connection with a merger, acquisition, or sale of all or a portion of our assets — you will be notified if your data becomes subject to a materially different privacy policy
  • With Your Consent: In any other circumstances with your explicit prior consent

6. Data Retention

We retain your personal data for as long as your account is active or as needed to provide the Service. Specific retention periods include:

  • Account data (name, email, company): Retained for the life of your account plus 90 days following deletion
  • Search history and usage logs: Retained for 24 months on a rolling basis, then aggregated or deleted
  • Bid alert configurations: Retained until you delete them or close your account
  • Billing records: Retained for 7 years as required by applicable tax and financial regulations
  • Support communications: Retained for 3 years to enable effective customer service
  • Security logs: Retained for 12 months to support fraud investigation and security monitoring

When you delete your account, we will delete or anonymize your personal data within 90 days, except where retention is required by law or for legitimate dispute resolution purposes.

7. Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal data:

7.1 Access

You may request a copy of the personal data we hold about you. We will respond to verified access requests within 30 days.

7.2 Correction

You may update or correct inaccurate personal data directly through your account settings, or by contacting us.

7.3 Deletion

You may request deletion of your personal data. We will honor deletion requests within 90 days, subject to retention requirements for legal compliance and billing records.

7.4 Data Export / Portability

You may request an export of your data in a machine-readable format (JSON or CSV). This includes your account profile, saved searches, alert configurations, and saved bids. To request an export, contact support@bidsnexus.com.

7.5 Opt-Out of Marketing Communications

You may opt out of non-essential marketing and product update emails at any time by clicking the "Unsubscribe" link in any marketing email, or by contacting support@bidsnexus.com. Note that even after opting out of marketing, you will continue to receive transactional emails and bid alerts that you have configured.

You may manage non-essential cookies through your browser settings as described in Section 3.

8. California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

8.1 Categories of Personal Information Collected

In the preceding 12 months, BidsNexus has collected the following categories of personal information from California consumers: Identifiers (name, email, IP address); Commercial information (subscription history, payment records); Internet or network activity information (browsing history on our Platform, search queries); Professional or employment-related information (company name, industry, NAICS codes); and Inferences drawn from the above to create a profile about your business interests and bid preferences.

8.2 Your CCPA Rights

  • Right to Know: The right to request disclosure of the categories and specific pieces of personal information we have collected about you
  • Right to Delete: The right to request deletion of personal information we have collected from you, subject to certain exceptions
  • Right to Correct: The right to request correction of inaccurate personal information
  • Right to Opt-Out of Sale or Sharing: BidsNexus does not sell or share personal information for cross-context behavioral advertising purposes. No opt-out is required, but you may submit a request to confirm this at any time.
  • Right to Limit Use of Sensitive Personal Information: We do not collect or use sensitive personal information beyond what is necessary to provide the Service.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.

To submit a CCPA rights request, email us at support@bidsnexus.com with the subject line "CCPA Rights Request." We will respond within 45 days, with an option to extend by an additional 45 days when reasonably necessary.

9. Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (TLS/SSL), hashed password storage, access controls limiting staff access to personal data, regular security assessments, and secure session management.

However, no method of transmission over the internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security. 10. Children's Privacy

The BidsNexus Platform is intended for business use by adults and is not directed at, nor does it knowingly collect personal information from, children under the age of 13 (or under 16 in applicable jurisdictions). If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at support@bidsnexus.com and we will delete such information promptly.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will notify you by updating the "Last updated" date at the top of this policy and, where required by law or where we deem appropriate, by sending a notification to the email address associated with your account.

We encourage you to review this Privacy Policy periodically. Your continued use of the Platform after any changes to this Policy will constitute your acceptance of the updated terms.
