South Dakota buys through a central state purchasing office, and its cities, counties and school districts buy on their own as well. To sell to the state you register once as a vendor, then watch for solicitations in your commodity codes and respond by the deadline. This page covers the state registration steps, where bids are posted and the programs that help small businesses, with links to the official pages.
How to register as a South Dakota vendor
- If you are a corporation, LLC, partnership or similar entity, register with the South Dakota Secretary of State (https://sdsos.gov) before any contract can be awarded, or state your exemption in the bid.
- Register online as a bidder in the ESM Solutions system through the SDOPM vendor information page and enter the required company information.
- Select every commodity category you supply; SDOPM is not responsible for missed notices if the right categories were not chosen.
- Receive email or fax notices of sealed bid and proposal opportunities and submit responses electronically through the eProcurement system unless the solicitation says otherwise.
- Keep your registration current in ESM Solutions; contact SDOPM at 605-773-3405 if you cannot register online.
Registration gets you on the state's list, but it rarely sends you every relevant bid. Many agencies, and most local governments, post on their own portals. A free BidsNexus alert watches the state portal and South Dakota's local agencies for you and emails the matches each morning.
Small business and certification programs
- Resident business and South Dakota-made product preference: State law gives a preference to resident businesses and goods manufactured in South Dakota when price, quality and service are substantially equal.
- Utilization of Minority Business Enterprises clause: On contracts over $5,000 that are not personal services, contractors agree to use best efforts to subcontract with businesses at least 50% owned by minority group members; the manual describes no state MBE certification or set-aside.
Federal set-asides work differently from state programs; see our guide to small business set-asides.
Cities, counties and school districts
SDOPM furnishes a State Contracts List to local governments, and state law lets local units of government buy items on state contracts directly from the contractor without competitive bidding. Local public agencies can also post notices through the state's Central Bid Exchange public solicitation notice form.
Local bids are where most small businesses win their first contracts: smaller dollar values, shorter responses and less competition from national firms. BidsNexus collects them into one list, so you can browse every open South Dakota bid in one place.
Tips specific to South Dakota
- Purchases up to $50,000 can be handled as informal Requests for Quotation by phone, in writing or through the eProcurement system, and agencies are not required to send these to every registered bidder.
- Sales representatives are welcome to visit SDOPM in Pierre; the manual recommends calling for an appointment.
- Motor vehicles must be bought from licensed South Dakota dealers only.
